Eminent domain is the power to take private property for public use by a state or other governmental authority.  The act of a state or governmental authority taking a private citizen’s or company’s property, for a public purpose, is generally known as condemnation. Among the more common uses of property taken by eminent domain are for public utilities, highways, buildings and railroads.  The attorneys of JOHNSON & DAVIS have significant experience both in prosecuting condemnation cases on behalf of the State of South Carolina, and in representing landowners whose property is being condemned. 

In South Carolina, a landowner whose property is the subject of a condemnation action is Constitutionally-entitled to just compensation, and, often times, a state or county’s or city’s interpretation of “just compensation” differs from that of the landowner whose property is being taken.  JOHNSON & DAVIS represents landowners in condemnation cases and in seeking that such just compensation be awarded to the landowner.
